Terms of Use

Effective date: 2 October 2026

These Terms of Use (the "Terms") are the end-user licence agreement for the Muddle app and the online services it uses (together, the "app"). Please read them before you use the app. By using the app you agree to these Terms. If you do not agree, do not use the app.

Who the agreement is with

These Terms are an agreement between you and Vadym Dzerniuk, Sumy, 40004, Ukraine ("we", "us").

They are not an agreement with Apple Inc. or Google LLC. We, not Apple or Google, are solely responsible for the app and its content. If you got the app from the App Store and these Terms set usage rules that are less restrictive than, or conflict with, the Apple Media Services Terms and Conditions, Apple's rules apply.

Who can use the app

The app shows and suggests alcoholic drinks. To use it, you must:

The app asks you to confirm your age the first time you open it. Answer honestly.

Your account

You sign in with your Google or Apple account. You are responsible for keeping that account secure and for what happens under your account in the app. Tell us at vdzerniuk@gmail.com if you think someone else is using it.

You can delete your account at any time under Profile → Account → "Delete account". The Privacy Policy explains what that deletes and what it does not.

Your licence to use the app

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app for your own non-commercial purposes:

You must not, and must not help anyone else to:

What the app does

The app keeps a list of the bottles on your shelf, shows which cocktails you can make from them, lets you save and rate recipes, and suggests drinks from TheCocktailDB. When no real cocktail fits your shelf, it can ask an AI model to invent one (an "AI invention").

The free plan

The free plan includes every feature except bottle-photo scanning and the stronger AI model, with up to 5 AI inventions per calendar month. A calendar month starts at 00:00 UTC on the 1st. Unused inventions do not carry over.

We may change the free plan's limits. The current numbers are always shown on the app's Subscription screen.

The Pro subscription

What Pro includes

Plans and payment

Pro is an auto-renewing subscription, offered monthly and yearly. The price, the length of the period and any introductory offer are shown in the App Store or Google Play before you confirm. Payment is taken by Apple or Google from your store account when you confirm the purchase. We never receive your payment details.

After a purchase, Pro can take a short time to appear in the app while the store confirms it. If you reinstall the app or change device, use "Restore purchases" on the Subscription screen.

Automatic renewal

Your subscription renews automatically at the end of each period, at the price then in effect, until you cancel it.

If the price changes, Apple or Google will tell you beforehand and, where required, ask for your consent.

Cancelling

Cancel through the store where you bought Pro:

When you cancel, you keep Pro until the end of the period you have already paid for. Deleting the app or deleting your account does not cancel your subscription. We cannot cancel a store subscription for you.

Refunds

Refunds are handled by Apple or Google under their own refund policies, not by us:

If a refund is granted, Pro ends straight away rather than at the end of the period.

AI-generated content

AI inventions are written by an AI model (Google's Gemini) that our server calls for you. Bottle-photo scanning and the translation of TheCocktailDB recipes into your language use the same kind of model. The app labels each recipe it returns as either an AI invention or a recipe from TheCocktailDB. When it cannot confirm that a recipe came from TheCocktailDB, it labels it as an AI invention.

AI output can be wrong. An AI invention may:

AI inventions are not reviewed by a person and are not checked for safety, allergens or alcohol content. Photo scanning can misread or miss bottles, which is why nothing is added to your shelf until you confirm it. Translations may contain mistakes; the English original is what TheCocktailDB published.

Use your own judgement before making or serving any drink, read every ingredient, and check product labels yourself.

Recipe data from TheCocktailDB

Recipes and pictures of real cocktails come from TheCocktailDB (https://www.thecocktaildb.com/), an independent database. That content belongs to TheCocktailDB and its contributors, and the app names them as its recipe and photo source in Profile, under Legal. We provide it as it is and do not check it for accuracy, allergens or safety. The recipes in the app's own built-in catalog were written for the app.

Responsible drinking

The app is a recipe reference. It does not encourage drinking, and nothing in it is medical, health or safety advice. Drink responsibly, never drink and drive, and follow the law on alcohol where you are. Our responsible drinking page says more, including where to find help.

Your content

The bottle names, recipes, ratings and other things you enter stay yours. You give us a licence to store, process and transmit them only as needed to run the app for you, including sending them to our service providers as the Privacy Policy describes. The licence ends when you delete the content or your account, except for copies that the Privacy Policy says are kept for longer.

Do not enter personal information about other people. Only use photos you are entitled to use, and do not photograph people for a bottle scan.

Privacy

The Privacy Policy explains what we collect and how we use it.

Maintenance and support

We alone are responsible for maintaining and supporting the app. Apple has no obligation at all to provide maintenance or support services for the app. For support, contact vdzerniuk@gmail.com.

We may change, update or remove features, and parts of the app depend on third parties (Google's Gemini API, TheCocktailDB, the app stores) that may be unavailable at times. We do not promise that the app will always be available or free of errors.

Warranty

To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied.

We alone are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid Apple for the app. To the maximum extent the law allows, Apple has no other warranty obligation of any kind with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our sole responsibility.

Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profit or goodwill, arising from your use of the app, and our total liability to you for all claims relating to the app is limited to the amount you paid for Pro in the 12 months before the claim arose.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited by law.

Product claims

We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including:

Intellectual property

The app, its design, code, text and built-in recipe catalog belong to us or our licensors, apart from third-party content such as TheCocktailDB's recipes and pictures. These Terms do not give you any rights in them beyond the licence above.

If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.

Third-party terms

When you use the app, you must also comply with the terms of the third-party services involved, such as the App Store or Google Play terms, the terms of your Google or Apple account, and your mobile or internet provider's terms.

Ending the agreement

You can stop using the app at any time and delete your account.

We may suspend or end your access if you seriously or repeatedly break these Terms, for example by trying to get around the monthly limits or by misusing the AI features. Where it is reasonable, we will tell you first and explain why.

When the agreement ends, your licence to use the app ends. A store subscription is not cancelled automatically; cancel it in your store account. The sections on AI-generated content, warranty, limitation of liability, product claims, intellectual property and governing law continue to apply.

Changes to these Terms

We may update these Terms. We will change the effective date at the top and, if a change materially affects you, tell you in the app before it takes effect. If you do not agree to the new Terms, stop using the app and cancel any subscription.

Governing law

These Terms are governed by the laws of Ukraine, and disputes will be heard by the courts of Sumy, Ukraine. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may be able to bring a claim in your local courts.

Apple as third-party beneficiary

You and we agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
